Professionals of the law firm TESET successfully represented one of insurers operating in Lithuania in a dispute regarding a satisfaction of recourse claim.

The insurer represented by us paid an insurance indemnity to a beneficiary under a surety insurance agreement and, after paying the insurance indemnity, claimed the paid amount from a legal entity, which, according to the agreement concluded with the insurer, undertook to return to the insurer the sums paid out under the surety insurance agreement.

Although a defendant initially did not recognise a statement of claim and its claims, the parties decided to enter into an amicable settlement agreement during a trial proceeding. Pursuant to this amicable settlement agreement, the claims of the insurer were substantially recognised and satisfied.

Professionals of the law firm TESET represented drafted procedural documents of the court case, collected additional evidences supporting the insurer’s position and represented the interests of the insurer at the court hearings.
